THE CONFLICT UNDER GEORG SIMMEL’S PERSPECTIVE AND THE “CRIMMIGRATIONâ€
is it possible to see any positive side in "crimmigration"?

This present article aims to analyze the “crimmigration†as a current expression to xenophobia, using Georg Simmel’s ideas on the conflict (where xenophobia can be included as one of its forms) as a theoretical referential. The originality of this work is to use Simmel’s and Carl Schmitt’s sociological theories about the formulation of the enemy in order to analyze how the “crimmigration†criminalizes the foreigner. It uses the qualitative bibliographic analysis. Initially, it shows how the xenophobia has always been present in history, as the foreigners were always seen as enemies. After, Simmel’s theory about the conflicts is studied, emphasizing its positive side and its sociological importance, analyzing if the migrations’ criminalization can be seen under any positive aspect, as supported by Simmel, under a theoretical sphere or if, in a practical way, it only caries negative elements. It’s concluded that the positive aspect is to avoid people’s conformation, forcing them to question and fight against it. This happened with the New Brazilian Migration Law, which promoted alterations on the nationalist and xenophobic paradigms of the previous law.
