A domesticação da improbabilidade
Uma interpretação (sistêmica) do processo de constitucionalização política

O artigo analisa o papel da constitucionalização na diferenciação funcional da sociedade moderna, com ênfase na visibilidade da contingência do poder. A partir de um diálogo entre Claude Lefort e Niklas Luhmann, sustenta-se uma interpretação do conceito de constituição democrática como mecanismo de institucionalização do conflito e de processualização da produção da coletividade como artefato do sistema político. Nesse processo, torna-se possível ao direito funcionar como sistema imunológico da sociedade, impedindo a interferência difusa do poder na operação de outros subsistemas. A constitucionalização democrática, portanto, não apenas estrutura o sistema político, mas condiciona a possibilidade de reprodução funcional do sistema jurídico e, por fim, da forma de diferenciação social moderna como um todo.Citas
