Abstract

The article in question aims to present some of the results of a study on sentencing decisions, in the first instance, of criminal drug trafficking cases in Goiânia. As a methodology, qualitative and quantitative techniques were used in the production and analysis of the database, in a comparative way, in an attempt to identify the legal behaviors of different judges, as well as the worldviews expressed in the legal documents and the narratives formulated in decision-making sentencing. The findings reveal an abysmal divergence in the way judges act in relation to this criminal matter. The differences found, in addition to expressing the internalization of different ethos about the social phenomenon of drugs and about the role of criminal law, show the configuration of different legal habitus, which, in turn, allow understanding how the differences of being of the magistrates themselves produces a differentiated management of punishment.

Bacharel em Ciências Sociais (2011), Mestre (2014) e Doutor (2019) em Sociologia pela Universidade Federal de Goiás. Pesquisador do Núcleo de Estudos sobre Criminalidade e Violência (NECRIVI), da Faculdade de Ciências Sociais da UFG, e do Núcleo de Estudos Interdisciplinares sobre Psicoativos (NEIP). Foi, de 2017 a 2018, bolsista do Programa de Doutorado-sanduíche no Exterior (PDSE/CAPES) no Instituto Vasco de Criminologia (IVAC-KREI), da Universidad del País Vasco (UPV), Espanha. Recebeu Menção Honrosa no Prêmio Anpocs Teses - edição 2020 (Região Sul/Centro-Oeste). Atualmente faz estágio pós-dotoural no Núcleo Interdisciplinar de Estudos e Pesquisas em Direitos Humanos (NDH/UFG). Atua nas áreas de teoria sociológica, metodologia de pesquisa, sociologia das drogas, mercados ilícitos, violência, criminalidade, segurança pública, direitos humanos e justiça criminal.
