Abstract

Based on the data on state spending on the judicialization of health, the text aims to discuss the economic integration between the judicialization of health in Brazil and the legal dogmatics, understand as a decision-making technique about the right to health. The research used bibliographic sources and empirical data on the costs of judicialization. The epistemological premise is the systems theory of Niklas Luhmann. The bibliographic sources were collected in direct and indirect sources. The direct sources were the texts written by Luhmann himself and the indirect sources were those written by his commentators.
