Abstract

This article seeks to analyze the Labor Reform of 2017 (Law 13.467 / 2017) from the articulation between the legal form and Brazilian dependent capitalism, in order to explain the upsurge in the overexploitation of the workforce in Brazil. To this end, initially, we will discuss Marxian social theory to highlight the foundations on which the aforementioned analytical categories are based, and then determine how such articulation can be useful for understanding the mode of social regulation of work in the country. Thus, starting from the dialectical historical materialism and a qualitative approach, it is argued that the Labor Reform more intensely highlights the genetics of Labor Law as a historical experience in Brazil, in this neoliberal period.
