Science via Law or Politics?
A systemic description about experts in the risk society

This paper discusses the allocation of legal decision to the field of experts and problematizes the theme of consequentialist argumentation via science. This description refers to the operations of technical bodies, mainly focused on sector regulation. Moreover, the paper applies the framework of Social Systems Theory, especially from the work of Niklas Luhmann and Raffaele De Giorgi, as both observe scientific communication limited to the social subsystem of science. This sociological observation indicates the intersystem problems that arise from these regulatory operations when law or politics do not respect the functional boundaries between system / environment. The point then is to understand how experts can decide and deal with the consequences vis-à-vis other legal decision-makers. The paper advances by debating the relationship between science and society, as well as the articulation of scientific communication by law and politics and the distinction danger / risk. An example of this analysis is the exam of “risk society” by De Giorgi and the research developed by the Center for Risk Studies.
