Abstract

The 2018 UN Declaration on the Rights of Peasants and Others Working in Rural Areas is one of the milestones that summarize the struggles of the peasantry. It is a historic achievement in the recognition of the peasantry as the holder of the right of access to land and reinforces the formation of collective subjects, the central object of reflection. Through bibliographic research, the research discusses the concepts and legal scope of the peasantry conception, as a collective subject of law, based on guarantees put in the UN Declaration, of 2018. The work consists of a brief overview of the conjunctural formation of the Declaration, as something that goes back to the struggles of previous decades, from a constellation of movements, peoples and rural communities that, to a large extent, maintained dialogue through Via Campesina. Subsequently, in a technical-legal sense, some of the main types of rights provided for in the Declaration and the interfaces with the formation and recognition of the collective subject of law are identified. The political dimension of the peasantry is revealed, under concepts that are linked both to the way of life, and by the mobilizing capacity to express a field of conflicts, imposing (and opposing) itself.
